1. Scope of Application
1.1 These General Terms and Conditions of Sale (“GTC”) of Master Investment Sp. z o.o., with its registered office at Rondo Organizacji Narodów Zjednoczonych 1, 00-124 Warsaw, entered in the Register of Entrepreneurs (KRS) under number 0000423812, VAT ID: 7010345632, REGON: 146168500 (hereinafter referred to as the “Seller”), shall apply to all contracts concluded between the Seller and Customers (both consumers and entrepreneurs) through the online store available at www.masterenergy.eu.
1.2 A consumer (hereinafter referred to as the “Customer”), within the meaning of these GTC, is a natural person undertaking legal actions not directly related to their business or professional activity. An entrepreneur is a natural person, legal entity, or organizational unit with legal capacity, who undertakes legal actions in the course of their business or professional activity.
2. Technical Requirements Necessary for Cooperation with the IT System
The online store allows ordering of the goods offered by the Seller using commonly available software, in the form of web browsers that accept cookies. The Seller is not responsible for the performance of third-party software installed on the Customer’s devices, which may affect the proper functioning of the store.
The Seller is not responsible for technical problems or limitations that occur in the computer equipment or software used by the Customer to access the online store, which prevent or hinder the Customer from using the Seller’s offer.
3. Conclusion of the Contract
3.1 A prerequisite for using the Seller’s offer is to first familiarize oneself with the purchase rules, the price list, and all the provisions of these Terms and Conditions provided on the website.
3.2 The information about products presented in the Seller’s online store constitutes an invitation for the Customer to make an offer, and does not constitute an offer in the sense of the Civil Code.
3.3 The Customer makes an offer to conclude a purchase contract by filling out the order form available on the store’s website (“Cart”) and submitting it. Upon placing the order, the Customer receives an order confirmation by e-mail, which constitutes the conclusion of the contract.
3.4 The Seller may refuse to fulfill an order in cases provided by law, e.g. in the event of an out-of-stock product. The Seller will make every effort to ensure that the products displayed in the online store correspond to the current stock levels. In the event of unavailability of all or part of the goods covered by the order, the Seller shall immediately notify the Customer and, if the Customer has already paid, refund the full amount received.
3.5 The store reserves the right to change the prices of the goods offered, to introduce new goods into the store’s offer, to conduct or cancel promotional actions on the store’s pages, or to make changes to them.
3.6 The Seller states that the photos and descriptions of the products are for illustrative purposes and may not reflect all the characteristics of the ordered product. In particular, the photos of products may differ from the ordered goods: in the case of products with variants, they may have a different color, size, or package volume. Depending on the monitor on which the product description is displayed, the photos may exhibit a different hue.
3.7 In the case of promotional sales and clearances, for which a limited number of goods is available, the fulfillment of the order will be carried out in the order of receipt of confirmed orders for those goods, until the available stock under this form of sale is exhausted.
3.8 The User receives proof of purchase in the form of an electronic or paper invoice based on the data provided in the order.
4. Right to Withdraw from the Contract
4.1 The Consumer has the right to withdraw from the contract within 14 days without giving any reason, in accordance with the Act of 30 May 2014 on Consumer Rights.
4.2 Detailed information on how to exercise the right to withdraw from the contract is provided in the instruction on the right of withdrawal.
5. Prices and Payment Terms
5.1 All prices listed in the Seller’s online store are expressed in Polish złoty (PLN) and include VAT. Additional delivery costs are indicated separately during the ordering process.
5.2 The Customer may make payment for the order using the available methods indicated on the store’s website, such as online payments, bank transfer, or cash on delivery (for orders up to a value of 8,000.00 PLN).
6. Delivery and Shipping Conditions
6.1 Delivery of goods is carried out within Poland and other European countries to the address provided by the Customer in the order. By prior arrangement, it is possible to personally collect selected products from the Warehouse in Skawina near Krakow.
6.2 The delivery time is indicated in the product description and in the order confirmation. The Seller makes every effort to ensure that deliveries are made in the shortest possible time.
6.3 In the case of shipments made to entrepreneurs, the risk of accidental loss or damage to the goods passes to the Customer at the moment the goods are handed over to the carrier.
7. Retention of Title
The Seller reserves ownership of the goods until full payment for the order has been received.
8. Liability for Defects (Warranty)
8.1 The Seller is liable to the Customer for physical and legal defects of the goods in accordance with the provisions of the Civil Code concerning warranty.
8.2 The Consumer has the right to submit a complaint in the event a defect is found in the goods. Detailed information regarding the complaint procedure is available in the “Complaints” section on the store’s website.
9. Governing Law
For contracts concluded between the Seller and the Customer, Polish law shall apply, excluding the provisions of the United Nations Convention on Contracts for the International Sale of Goods.
In matters not regulated by these Terms and Conditions, the provisions of Polish law shall apply, in particular the provisions of the Civil Code (Journal of Laws 1964 No. 16, item 93), the Act on the Provision of Electronic Services (Journal of Laws 2002 No. 144, item 1204), the Act on Consumer Rights (Journal of Laws 2014, item 827), as well as the Act of 29 August 1997 on the Protection of Personal Data (Journal of Laws 1997 No. 133, item 883).
The Consumer has the option to use out-of-court methods for handling complaints and pursuing claims.
