1. Scope of Application

1.1 These General Terms and Conditions of Sale (“GTC”) of Master Investment Sp. z o.o., with its registered office at Rondo Organizacji Narodów Zjednoczonych 1, 00-124 Warsaw, Poland, registered in the Register of Entrepreneurs (KRS) under number 0000423812, VAT ID: 7010345632, REGON: 146168500 (hereinafter referred to as the “Seller”), apply to all contracts concluded between the Seller and Customers (both consumers and businesses) via the online store available at www.masterenergy.eu.

1.2 A consumer (hereinafter referred to as the “Customer”) is defined as a natural person engaging in legal actions not directly related to their business or professional activities. A business entity refers to a natural person, legal entity, or organizational unit with legal capacity, conducting legal transactions in the course of business or professional activities.

2. Technical Requirements Necessary for Cooperation with the IT System

The online store enables Customers to place orders using commonly available web browsers that accept cookies.

  • The Seller is not responsible for the performance of third-party software installed on the Customer’s device that may impact the store’s functionality.
  • The Seller is not liable for technical issues or limitations of the Customer’s hardware or software that may prevent or restrict access to the online store.

3. Conclusion of the Contract

3.1 Before making a purchase, Customers must review the purchase rules, pricing, and these Terms and Conditions, all of which are available on the website.

3.2 The product descriptions on the Seller’s website serve as an invitation to make an offer rather than a legally binding offer under the Civil Code.

3.3 A contract is concluded when the Customer:
✔️ Fills out the order form available in the online store (“Cart”).
✔️ Submits the order.
✔️ Receives an order confirmation email, which constitutes acceptance of the contract.

3.4 The Seller reserves the right to decline an order in cases permitted by law, such as product unavailability. In such instances, the Seller will notify the Customer and, if payment has already been made, provide a full refund.

3.5 The Seller reserves the right to:
✔️ Modify product prices.
✔️ Introduce or discontinue products.
✔️ Conduct or cancel promotions.

3.6 Product images and descriptions are for illustration purposes only and may not fully reflect the final product (e.g., colors, sizes, packaging may vary).

3.7 Orders for promotional or clearance items are processed on a first-come, first-served basis, while stock lasts.

3.8 Customers will receive an electronic or paper invoice as proof of purchase.

4. Right to Withdraw from the Contract

4.1 Consumers have the right to withdraw from the contract within 14 days without providing any reason, in accordance with the Consumer Rights Act of May 30, 2014.

5. Prices and Payment Terms

5.1 All product prices are displayed in Polish złoty (PLN) and include VAT. Any additional delivery charges are displayed separately during checkout.

5.2 Customers may pay using the following methods:
✔️ Online payments (via payment gateways).
✔️ Bank transfer.

6. Delivery and Shipping Conditions

6.1 Products are delivered within Poland and selected European countries to the address provided by the Customer. Personal collection from the Warehouse in Skawina is available by prior arrangement.

6.2 The estimated delivery time is specified in the product description and in the order confirmation email. The Seller makes every effort to ensure fast and timely deliveries.

6.3 For business transactions, the risk of accidental loss or damage transfers to the Customer when the goods are handed over to the carrier.

7. Retention of Title

The Seller retains ownership of all goods until full payment for the order has been received.

8. Liability for Defects (Warranty)

8.1 The Seller is responsible for physical and legal defects in the goods, in accordance with the provisions of the Civil Code regarding warranty.

8.2 Consumers have the right to submit a complaint if defects are found in the purchased goods. The detailed complaint procedure is available in the Complaints section on the store’s website.

9. Governing Law

9.1 Contracts between the Seller and Customers are governed by Polish law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

9.2 Any matters not covered by these Terms and Conditions are subject to Polish legal regulations, including:

  • The Civil Code (Journal of Laws 1964 No. 16, item 93).
  • The Act on the Provision of Electronic Services (Journal of Laws 2002 No. 144, item 1204).
  • The Consumer Rights Act (Journal of Laws 2014, item 827).
  • The Act on the Protection of Personal Data (Journal of Laws 1997 No. 133, item 883).
